Limited product warranty for new OUMURS helmets sold in the United States

Safety first
Stop using a helmet that has been involved in a crash, sustained a significant impact, or may be defective. A helmet can be damaged without visible signs. This warranty does not make a crashed helmet safe to reuse.
1. Warrantor and scope
This One-Year Limited Helmet Warranty (“Limited Warranty”) is provided by OUMURS ACCESSORY INDUSTRIAL LIMITED (also known as “OUMURS”). It applies to a new, genuine OUMURS helmet purchased for personal use in the United States from www.oumurs.com, an official OUMURS marketplace storefront, or an authorized OUMURS retailer, provided the seller of record is OUMURS or another seller authorized by OUMURS.
The Limited Warranty is for the original retail purchaser and a person who received the new helmet as a gift from that purchaser. It is not transferable after resale. Proof of purchase from an eligible seller is required. Separate accessories are covered only if their product page or written warranty expressly says so.
2. Warranty period
The warranty period is one year from the original retail purchase date. If valid proof of purchase does not show the date, OUMURS may use other reliable records or the date reasonably associated with manufacture or delivery, to the extent permitted by law.
A replacement helmet or component is covered for the longer of the remaining original warranty period or 90 days after shipment of the replacement, unless applicable law requires a longer period.
3. What is covered
During the warranty period, OUMURS warrants that the helmet will be free from defects in materials and workmanship under normal, intended use and care. Covered helmet components may include:
· The outer shell and energy-absorbing liner;
· The factory-installed chin strap, retention system, and buckle;
· Factory-installed visor, shield mechanism, vents, and fasteners;
· The comfort liner and cheek-pad attachment system; and
· Factory-installed electrical components, if included with the specific model.
Coverage applies only when the condition is caused by a defect in materials or workmanship, not merely because a component has worn, aged, been damaged, or does not suit the user’s personal preference.
4. What is not covered
This Limited Warranty does not cover:
· A crash, fall, impact, crushing, dropping, collision, or other external force, whether or not damage is visible;
· Normal wear, cosmetic scratches, fading, discoloration, odor, interior compression, visor wear, battery depletion, or deterioration from age or ordinary use;
· Sizing, fit, comfort, noise, airflow, fogging, or personal preference that is not caused by a manufacturing defect;
· Misuse, abuse, neglect, improper storage, incorrect cleaning, failure to follow instructions, or use for an activity or environment for which the helmet was not designed;
· Exposure to excessive heat, solvents, fuels, adhesives, paints, cleaners, chemicals, or other substances that can damage helmet materials;
· Drilling, cutting, painting, heating, structural modification, removal of protective material, or installation of unapproved components;
· Damage caused by an incompatible third-party accessory, camera mount, communication device, visor, part, service, or repair;
· Loss, theft, counterfeit goods, used goods, unauthorized resale, or a purchase without acceptable proof from an eligible seller;
· Removal or alteration of the serial number, date code, certification label, warning label, or other identifier when that prevents reliable verification of the product or claim; or
· Delivery damage that should be handled under the seller’s delivery-claim or return process, without limiting rights for a hidden defect.
Using a third-party part or repair service does not by itself void this Limited Warranty. OUMURS may deny coverage only to the extent that the third-party part, alteration, or service caused or contributed to the claimed damage, or prevents us from evaluating the claim.
5. How to make a claim
1. Stop using the helmet if the issue could affect safety.
1. Email contact@oumurs.com during the warranty period. Include the purchaser’s name, order or receipt number, purchase date, seller, model, size, color, a description of the issue, and when it began.
2. Provide clear photographs of the complete helmet, the claimed condition, interior and exterior labels, date or serial code, and proof of purchase. We may request additional information reasonably needed to evaluate the claim.
3. Follow the written inspection or return instructions. Do not ship a helmet until authorized, and do not send it to the Hong Kong office unless specifically instructed.
OUMURS may inspect the product and may use photographs, service records, test results, or other reasonable evidence. We will not require the customer to pay a fee merely to submit a warranty claim.
6. Remedies
If OUMURS confirms a covered defect during the warranty period, OUMURS will, at its option and without charge for the covered remedy:
· Replace a non-structural, user-replaceable component;
· Replace the helmet with the same model or a new or functionally comparable OUMURS helmet; or
· Refund the original purchase price if a suitable replacement is not reasonably available.
OUMURS will not structurally repair or return to service a helmet with a potentially compromised shell or energy-absorbing liner. A replacement may differ in color, graphics, minor features, or packaging. For an approved U.S. claim, OUMURS will pay reasonable authorized shipping required to provide the covered remedy.
These remedies are in addition to any remedy that applicable law requires. OUMURS may require return or documented destruction of a replaced or refunded helmet to prevent unsafe reuse.
7. No guarantee against injury
No helmet can protect against every foreseeable impact or prevent all injury or death. This Limited Warranty concerns defects in materials and workmanship; it is not a promise that injury cannot occur or that the helmet is appropriate for every activity. Use the helmet only as instructed and replace it after a crash or significant impact.
8. Implied warranties and limitation of damages
To the extent permitted by law, any implied warranty, including an implied warranty of merchantability or fitness for a particular purpose, is limited to the duration of this one-year Limited Warranty. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
To the extent permitted by law, OUMURS is not responsible under this Limited Warranty for incidental or consequential damages. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Nothing in this Limited Warranty excludes or limits liability or a remedy that cannot lawfully be excluded or limited, including applicable rights relating to personal injury, product liability, fraud, or statutory consumer warranties.
9. Your legal rights
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State. This Limited Warranty does not replace or reduce any non-waivable right or remedy under federal, state, or local law.
10. Recalls and safety notices
A safety recall or corrective-action program is separate from this Limited Warranty and may apply after the warranty period. Follow any recall or safety notice associated with your product. Contact OUMURS if you believe a helmet presents a safety risk.
11. Governing law
Subject to the mandatory consumer protections described above, this Limited Warranty is governed by the laws of the Hong Kong Special Administrative Region, China, without regard to conflict-of-law principles. This choice does not deprive a U.S. consumer of rights that applicable law makes non-waivable.
