Rules for using www.oumurs.com and purchasing OUMURS products

Important helmet notice
Motorcycling, off-road riding, and similar activities involve risk of serious injury or death. No helmet can prevent every injury. Read all product instructions and warnings, choose the correct model and size for the intended activity, and replace any helmet that has sustained an impact.

1. About these Terms

These Terms & Conditions (the “Terms”) govern access to and use of www.oumurs.com and related pages, features, content, communications, and services (collectively, the “Site”), and purchases made through the Site for delivery to the United States. The Site is operated by OUMURS ACCESSORY INDUSTRIAL LIMITED (also known as “OUMURS,” “we,” “us,” or “our”), a company organized under the laws of the Hong Kong Special Administrative Region, China.

By accessing the Site, creating an account, submitting an order, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site. Additional terms displayed for a promotion, product, service, or checkout feature also apply; if they conflict with these Terms, the more specific terms govern for that subject.

You must be at least the age of legal majority where you live, or use the Site with the involvement and permission of a parent or legal guardian who accepts these Terms.

2. Our policies

The following policies form part of these Terms and should be read together with them where applicable to the product, service, or interaction involved:

· Any shipping, promotion, or product-specific terms displayed on the Site.

If a policy gives you greater rights than these Terms, that policy controls for its subject. Nothing in these Terms limits a right or remedy that cannot lawfully be waived.

3. Product information and availability

We try to present accurate product descriptions, images, specifications, sizing information, colors, prices, and availability. Display settings, manufacturing changes, and normal variation may affect appearance. Unless a specific result is expressly promised in a written limited warranty, product information is descriptive and not a guarantee that a product will be suitable for every rider, vehicle, climate, activity, or jurisdiction.

Products and features may be changed or discontinued, and quantities may be limited. We may correct errors and update information, including after an order is submitted. If a material error affects an accepted order, we will contact you and provide an appropriate option, which may include cancellation and refund.

Certification or compliance statements apply only to the specific model, size, configuration, market, and labeling identified. A statement that a helmet is certified to a standard does not mean that a government agency has approved or endorsed the product. Do not remove required safety or certification labels while the helmet is in use.

4. Helmet fit, use, and safety

· Fit and selection. You are responsible for selecting the correct helmet type and size for the intended activity. A properly fitted helmet should be snug, stable, and worn with the retention system securely fastened.

· Instructions and warnings. Read and follow the manual, labels, sizing guide, care instructions, and warnings supplied with the helmet. Do not alter, drill, paint, heat, chemically treat, or attach items to a helmet except as expressly permitted by OUMURS.

· Impact replacement. Stop using and replace a helmet after a crash or significant impact, even if damage is not visible. Protective materials may be compromised without obvious exterior damage.

· Condition. Inspect the shell, energy-absorbing liner, retention system, visor, hardware, and accessories before each use. Do not use a helmet that is damaged, deteriorated, improperly fitted, recalled, or missing required components.

· Local requirements. You are responsible for confirming that the product and its use comply with applicable laws and rules where it will be used.

5. Accounts and information you provide

You may need to provide account, contact, billing, delivery, or other information. You agree that the information you provide is accurate and current. You are responsible for safeguarding account credentials and for activity under your account. Notify us promptly at contact@oumurs.com if you suspect unauthorized access.

We may suspend or terminate an account when reasonably necessary to protect customers, the Site, our rights, or others; investigate suspected fraud or misuse; comply with law; or enforce these Terms.

6. Orders and contract formation

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We accept the order when we dispatch the product or otherwise expressly confirm acceptance. We may decline or cancel an order before acceptance for reasons such as inventory limits, suspected fraud, pricing or listing errors, payment authorization failure, delivery restrictions, or legal requirements, and we will provide any refund required for amounts already collected.

If we cancel after payment has been collected, we will refund the affected amount to the original payment method. We may limit quantities or orders placed by the same customer, account, household, payment method, billing or delivery address, reseller, or distributor when reasonably necessary.

7. Prices, payment, taxes, and promotions

Prices are shown in the currency displayed at checkout. Unless stated otherwise, prices exclude delivery charges, customs duties, import fees, and taxes that are calculated or disclosed at checkout or imposed by authorities. If any customs duty, import fee, brokerage fee, or tax is the customer’s responsibility, OUMURS will disclose that responsibility at checkout or in the applicable shipping terms where required by law. You authorize OUMURS and its payment providers to charge the selected payment method for the total shown at checkout.

Promotional offers are subject to their stated terms, availability, and end dates. They cannot be combined unless we say otherwise and have no cash value except where required by law. A discount does not make an item final sale unless the item or promotion is clearly identified as final sale before purchase.

8. Shipping, delivery, title, and risk

Delivery dates are estimates unless we expressly agree otherwise. Events outside our reasonable control may cause delay. You are responsible for providing a complete and accurate delivery address. Any title, risk-of-loss, customs, import-duty, or delivery responsibility that applies to your order will be determined by the delivery terms shown at checkout and applicable law.

Nothing in this section limits any non-waivable consumer right relating to delivery, loss, or damage.

9. Returns, refunds, and warranty

Eligible change-of-mind returns for helmets are governed by the 30-Day Helmet Return Policy in this pack. Returns for other motorcycle parts, rider gear, accessories, or other products are governed by the return terms displayed for those products or at checkout, if different. Defects are governed by the One-Year Limited Helmet Warranty where it applies, any product-specific written warranty, and any non-waivable statutory rights. Return authorization does not guarantee a refund; returned items are inspected for eligibility. Refund timing may also depend on the payment provider or financial institution.

10. Marketplace and authorized-retailer purchases

A purchase made through a third-party marketplace or retailer is also subject to that seller’s order, payment, delivery, and return procedures. Begin order-related requests with the marketplace or retailer shown on the receipt. OUMURS may request proof of purchase and may assist with an eligible product warranty or safety-support claim, but we do not control third-party platforms or sellers and cannot issue a refund for money collected by an unrelated seller unless OUMURS expressly agrees.

11. Reviews, submissions, and user content

If you submit a review, photo, video, comment, idea, or other content (“User Content”), you retain ownership of your content. You grant OUMURS a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, reproduce, display, adapt, translate, publish, and distribute the User Content for operating, improving, and promoting OUMURS and its products, subject to applicable privacy and advertising law. This license ends for future use when required by law, but does not require us to recall materials already lawfully produced or distributed.

You represent that you have the rights and permissions needed for the User Content and that it is truthful, not misleading, and does not violate law or another person’s rights. We may moderate or remove User Content, but are not obligated to publish or monitor it. Do not submit sensitive personal information in public content.

12. Intellectual property

The Site and its text, graphics, photographs, video, logos, product names, designs, software, and other content are owned by or licensed to OUMURS and are protected by intellectual-property laws. Subject to these Terms, OUMURS grants you a limited, revocable, non-transferable right to access and use the Site for personal, non-commercial shopping and information purposes.

You may not copy, scrape, republish, sell, reverse engineer, create derivative works from, or exploit the Site or its content except as permitted by law or with our written permission. Send marketing, media, and intellectual-property inquiries to marcom@oumurs.com.

13. Acceptable use

You must not:

· Use the Site for unlawful, fraudulent, deceptive, abusive, or harmful purposes;

· Interfere with security, access controls, networks, or operation of the Site;

· Introduce malware, automate access in a way that burdens the Site, or attempt to gain unauthorized access;

· Impersonate another person, misrepresent affiliation, or submit false order or account information;

· Use Site content or customer information to build a competing database, train a model, or conduct unsolicited marketing without authorization; or

· Circumvent purchase limits, product restrictions, or measures intended to prevent fraud or abuse.

14. Third-party services and links

The Site may use or link to services provided by Shopify, payment providers, social networks, marketplaces, carriers, and other third parties. Third parties operate under their own terms and privacy notices when they act independently. OUMURS is not responsible for a third-party site or service merely because it is linked or integrated, but this does not limit responsibility we have under applicable law for service providers acting on our behalf.

15. Disclaimers

To the fullest extent permitted by law, the Site and its informational content are provided on an “as is” and “as available” basis. We do not promise that the Site will be uninterrupted, error-free, secure, or free of harmful code. Product warranties are only those expressly stated in the applicable limited warranty or required by law.

Nothing in these Terms excludes or limits an express product warranty, liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be limited, or any other right or liability that cannot lawfully be excluded.

16. Limitation of liability

To the fullest extent permitted by law, OUMURS and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from use of the Site or a purchase, even if advised that such loss was possible.

Where liability may lawfully be limited, OUMURS’s aggregate liability arising from a particular order will not exceed the amount paid for that order. This limitation does not apply to a claim that cannot legally be limited, including applicable product-liability, personal-injury, consumer-protection, or statutory-warranty claims. Some jurisdictions do not allow certain exclusions or limitations, so they may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to indemnify OUMURS from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Site, your User Content, or your material breach of these Terms. This does not require a consumer to indemnify OUMURS for OUMURS’s own negligence, defective products, breach, or violation of law.

18. Force majeure

OUMURS is not responsible for delay or failure caused by events beyond its reasonable control, such as natural disasters, severe weather, fire, epidemic, war, civil disorder, labor disruption, carrier interruption, supply shortage, cyberattack, utility failure, or government action. We will take reasonable steps to reduce the effect and perform when practicable. This section does not remove rights that applicable law gives you for delayed or undelivered goods.

19. Governing law and disputes

These Terms, the Site, and contracts for purchases made through the Site are governed by the laws of the Hong Kong Special Administrative Region, China, without regard to conflict-of-law principles. The courts of the Hong Kong Special Administrative Region will have non-exclusive jurisdiction over disputes arising from or relating to these Terms, the Site, or a purchase, except where a U.S. consumer has a non-waivable right to bring a claim in another court or forum under applicable federal, state, or local law.

Before starting formal proceedings, you and OUMURS are encouraged to contact the other party and attempt in good faith to resolve the dispute. Nothing in this section deprives a consumer of non-waivable protections or the right to bring a claim in a court or forum available under mandatory law in the place where the consumer resides.

20. Changes, suspension, and termination

We may update these Terms by posting a revised version and new effective date. Changes apply prospectively unless law permits otherwise. If a change materially affects existing rights, we will provide notice when required. We may modify or discontinue Site features, but this does not alter an accepted order or accrued legal right without a lawful basis.

21. General terms

If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; OUMURS may assign them as part of a merger, reorganization, sale of assets, or transfer of the business, provided consumer rights are not reduced. These Terms and incorporated policies are the entire agreement about their subject, except for any express written product or promotional terms.
